Delhi Pollution Control Committee (DPCC) Consent

DPCC (Delhi Pollution Control Committee) is the environmental regulatory body for Delhi NCR, responsible for implementing environmental laws. Any industry or business that may generate air, water, or noise pollution needs DPCC consent. This includes manufacturing units, processing plants, hospitals, laboratories, and even some commercial establishments. White category businesses (pure offices, IT) are generally exempt.

CTE (Consent to Establish) is required before setting up a new facility — it's DPCC's approval that your proposed facility meets environmental norms. CTO (Consent to Operate) is required before starting actual operations — it confirms that pollution control equipment is installed and working. You need CTE first, then CTO. CTO must be renewed periodically (annually or as specified by DPCC).

DPCC classifies industries into Red (high pollution), Orange (medium), Green (low), and White (minimal) categories based on the nature of operations, emissions, and effluents. We assess your specific business activity, raw materials, and processes to determine the correct category. This is the first step in our DPCC authorization process.

Operating without DPCC consent is a violation of the Water Act (1974) and Air Act (1981). Penalties include: imprisonment up to 6 years, fines up to ₹10,000 with additional ₹5,000/day for continuing violations, closure of the unit by DPCC, and prosecution in the National Green Tribunal. CTO validity depends on the category — Red category typically gets 1-year CTO, Orange gets 2-3 years, and Green gets 3-5 years. Renewal must be applied for before expiry. CTE processing takes 30-60 days depending on the category. CTO is granted after inspection, which can take another 15-30 days. Red category industries with EIA requirements may take 90+ days. After obtaining DPCC consent, you must: maintain pollution control equipment in working condition, submit periodic environmental monitoring reports, conduct regular water and air quality testing, maintain hazardous waste disposal records, and allow DPCC inspections.
